One of the worst tax violations is the failure of an employer to remit payroll taxes that have been withheld from its employees’ pay. Despite its gravity, it is also one of the most frequent tax problems encountered. Tapping the income and FICA taxes that have been withheld from employees to pay other creditors instead of depositing them with the government can be very tempting to a business owner or manager experiencing cash flow issues. Doing so can result in civil and criminal penalties.
